In a startling display reminiscent of authoritarian regimes, a mother in Arizona was arrested after speaking out against a proposed salary increase for a city official.

Rebekah Massie, a 32-year-old resident of Surprise, Arizona, found herself in handcuffs after allegedly violating a city law that forbids criticizing city officials at public meetings—a rule that has drawn widespread condemnation for its apparent infringement on free speech.

The incident occurred at a city council meeting on August 20, where Massie voiced her opposition to a proposed $12,000 raise for Surprise City Attorney Robert Wingo, who already reportedly earns $266,000 annually.

Massie’s concerns centered on what she perceived as Wingo’s inadequate handling of issues related to campaign signs, a matter she believed warranted public scrutiny.

However, Mayor Skip Hall quickly interrupted Massie, citing a city regulation that prohibits individuals from using their allotted time at the podium to “lodge charges or complaints against any employee of the city or members of the body.”

Massie defended her remarks, asserting, “That’s all fine and good, but that’s a violation of my First Amendment rights.”

The mayor, unfazed, warned her to desist from what he characterized as a personal attack on the city attorney. When Massie continued to assert her right to free speech, the situation escalated.

Mayor Hall instructed the city’s police chief to remove Massie from the chamber.

“Chief, could you have somebody come down here and escort Ms. Massie out of this chamber,” Hall ordered. As officers approached, Massie, standing beside her 10-year-old daughter, questioned the mayor’s directive.

“In front of my 10-year-old daughter, you’re going to escort me out for expressing my First Amendment rights?” she asked, according to local radio station KJZZ.

Following her removal, Massie was charged with trespassing, resisting arrest, and obstructing government operations.

Her arrest has sparked outrage among free speech advocates, particularly the Foundation for Individual Rights and Expression (FIRE), which has vowed to take legal action against the city of Surprise.

FIRE attorney Conor Fitzpatrick emphasized the broader implications of the incident, stating, “The First Amendment protects every American’s right to criticize public officials. And the last thing people should fear when they go to a city council meeting to make their voice heard is leaving in handcuffs. FIRE looks forward to vindicating Rebekah’s constitutional rights in court.”

Massie, for her part, remains resolute in her stance.

In a statement released after the arrest, she underscored her commitment to civic engagement and the protection of fundamental rights. “As an American, it’s my right to speak out to keep the local government accountable,” Massie declared.

“And as a mom, it’s my obligation to set a good example and stand up for our fundamental rights—like the right of free speech—when they’re threatened. That’s the lesson I wanted to show my daughter. And now, it’s the lesson I am determined to show the City of Surprise, Arizona.”
