  • Olivier Martinez left court looking agitated and distressed during closed testimony, then returned with lawyer Patrick Baghdaserians roughly five minutes later.
  • Halle Berry took the stand Tuesday, while Martinez is also scheduled to testify in the domestic violence restraining order hearing.
  • The judge closed the courtroom for testimony involving Berry and Martinez’s son, Maceo, who previously testified for nearly four hours.
  • Martinez requested a temporary restraining order and sole custody, while Berry’s attorney called his allegations “entirely meritless and deliberately misleading.”

Halle Berry’s former husband Olivier Martinez stormed out of a Los Angeles courtroom Tuesday while closed testimony unfolded in the former couple’s domestic violence restraining order hearing. Page Six reported that the French actor, 60, appeared agitated and distressed as he left with his lawyer, Patrick Baghdaserians.

Martinez could be heard using profanity during what was described as an animated conversation with Baghdaserians about testimony in the case. The two then headed toward the restroom before returning to the courtroom roughly five minutes later.

The tense exit came as Jon Hay, a staff member at the school attended by Berry and Martinez’s son, Maceo, was set to testify Tuesday behind closed doors. A recent court filing said Hay had previously raised concerns about the 13-year-old’s behavior at school.

Berry, 60, also took the stand on Tuesday as the hearing continued. Martinez is scheduled to give testimony as well, placing both former spouses among the witnesses expected to address the court during the proceedings.

The judge agreed that the courtroom would be closed whenever testimony involved the minor child. That decision kept those portions of the hearing from public view while witnesses spoke about matters concerning Maceo.

The former couple’s strained dynamic has also been visible during their appearances in court. Page Six previously reported that Berry and Martinez kept their distance from each other and exchanged cold glares on Monday, one day before Martinez’s abrupt departure during Tuesday’s closed proceedings.

Maceo testified in person for nearly four hours on the first day of the hearing. Berry’s daughter, Nahla Aubry, 18, is also set to testify later this week, extending the testimony to another member of Berry’s family.

Nahla is Berry’s daughter with model Gabriel Aubry, 50. In an earlier court declaration, she defended her mother and wrote that she had “never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way.”

Her declaration directly addressed the allegations now surrounding the former couple’s legal fight. The court hearing follows Martinez’s move earlier this month to seek a temporary restraining order against Berry and request sole custody of the child he shares with her.

In his filing, Martinez accused Berry of acting violently toward their son while her fiancé, Van Hunt, was present. The source report did not include further details of the allegation, which is part of the dispute unfolding in court.

Berry has denied the accusations through her attorney, Marina Beck. Beck described Martinez’s claims as “entirely meritless and deliberately misleading,” delivering a forceful response as the former spouses prepared to present their competing positions in court.

Tuesday’s developments brought several threads of the dispute into the same courtroom: Berry’s testimony, Hay’s expected appearance, and Martinez’s scheduled turn on the stand. The judge’s closure order applied when the evidence concerned Maceo, limiting public access during those portions.

The hearing also follows testimony from Maceo himself, whose nearly four hours in court occurred on the proceeding’s first day. Nahla’s expected appearance later in the week will come after her declaration rejected the idea that she had witnessed Berry physically abusing Maceo.

Berry and Martinez married in 2013, the same year Maceo was born. They separated two years later, and their current courtroom battle has now drawn testimony or expected testimony from both parents, Maceo, Nahla, and a staff member from Maceo’s school.

Martinez’s visible agitation on Tuesday marked a sharp moment in proceedings already characterized by distance between the former spouses. He and Baghdaserians returned after roughly five minutes, and the hearing continued with Berry taking the stand and Martinez still due to testify.

The court is considering a request that includes both a temporary restraining order and sole custody. Testimony scheduled across the week includes accounts from the former couple, their son, Berry’s daughter, and Hay, whose earlier school concerns appeared in a recent filing.
